A Federal High Court sitting in Abuja on Tuesday, March 20, dismissed a suit seeking the sack of the Kogi state governor, Yahaya Bello.
The Nation reports that the court in its ruling upheld an objection raised against the suit by Bello (who was sued as the 1st defendant), to the effect that the plaintiffs had no locus standi to institute the suit.
Justice John Tsoho said the plaintiffs could not challenge the right of second defendant (All Progressives Congress) to substitute/nominate the first defendant as its flag bearer in place of a dead gubernatorial candidate in the 2015 Kogi governorship election.

Justice Tsoho said the decision was the solely that of the second defendant and could not form a basis for any legal dispute between the plaintiffs and defendants.
He also said that the plaintiffs were neither members of the APC nor aspirants in the primary election that produced Bello as the APC’s flag bearer in the governorship election.
He further ruled that the subject matter of the suit was not within the jurisdiction of the court as it was not a pre-election matter.

A suit with number FHC/ABJ/CS/488/2017 was filed by three individuals -Michael Elokun, Ibrahim Sule and Hawa Audi - who described themselves as electorate in Kogi state.
The trio in their suit prayed the court to sack Yahaya Bello who became the governor of Kogi state after the death of the flag bearer of the party, Audu Abubakar, in the state.
NAIJ.com earlier reported that a member of the House of Representatives, James Falake, had accused the Kogi governor of increasing the level of attacks in the state.
Faleke said Bello was giving a "blank cheque" to some suspected herdsmen to operate fully in the state.

He also described the killings as the height of wickedness just as he called on the state government to take responsibility for the incident and for what he called the latter’s failure.
